GENERAL TERMS AND CONDITIONS (GTC)

for Digital Content and Online Events

§ 1 Scope of Application

  1. These General Terms and Conditions (“GTC”) apply to all contracts for digital content and online events concluded between

Dr. Andreas Tilch UG (limited liability), Germany
– hereinafter referred to as “Provider” –

and you as a consumer or entrepreneur worldwide.

  1. A consumer is any natural person acting for purposes predominantly outside their trade, business, or profession.

  2. An entrepreneur is any natural or legal person acting in the exercise of their commercial or independent professional activity.

  3. These GTC apply exclusively.

  4. The contract language is English.

§ 2 Reseller Model (Digistore24)

  1. The products are sold via the reseller:

  1. The purchase contract is concluded exclusively between you and Digistore24.

  2. Digistore24 is responsible for:

    • Order processing
    • Payment processing
    • Invoicing
    • Handling of withdrawal and refunds
  3. The Provider delivers the contractual content services (digital content and live online events).

  4. The terms and conditions of Digistore24 apply in addition.


§ 3 Subject Matter of the Contract

The Provider offers independent digital products:

  • Online courses (membership area with digital content)
  • Live online Q&A sessions

Each product constitutes a separate contractual service.


§ 4 Right of Withdrawal and Refund Policy

1. Statutory Right of Withdrawal (EU/EEA Consumers)

If you are a consumer residing within the European Union (EU) or the European Economic Area (EEA), you have a statutory right of withdrawal of 14 days from the conclusion of the contract.

For digital content not supplied on a tangible medium, the right of withdrawal expires prematurely if:

  • you expressly consent to the Provider beginning performance before expiry of the withdrawal period, and
  • you acknowledge that you thereby lose your right of withdrawal once performance has begun.

Activation of access to the digital content constitutes commencement of performance.


2. Customers Outside the EU/EEA

For customers residing outside the EU/EEA, no statutory right of withdrawal applies unless mandatory consumer protection laws of the country of residence provide otherwise.


3. Voluntary Refund Policies via Digistore24

Any refund rights beyond statutory withdrawal rights are governed exclusively by the terms and policies of Digistore24 GmbH.

Digistore24 may grant extended refund periods (for example up to 60 days) under its own commercial policies. Such refund rights are granted and processed exclusively by Digistore24.

The Provider has no independent obligation beyond statutory requirements.


§ 5 Prices and Payment

  1. The prices displayed at the time of purchase apply.

  2. Payment processing is carried out exclusively via Digistore24.

  3. Installment payments may be offered. In such case, the total purchase price remains due.

  4. For EU consumers, VAT may be charged according to the country of residence under the EU One‑Stop‑Shop (OSS) scheme.


§ 6 Online Courses (Membership Area)

  1. Access is granted after successful payment.

  2. Access is limited to 24 months from activation unless otherwise stated.

  3. Video content is available for streaming only. There is no entitlement to download video materials.

  4. Supplementary materials (e.g., PDFs) may be stored for personal use only.

  5. After expiration of the access period, there is no entitlement to continued availability.

  6. Necessary security-related updates will be provided during the access period in accordance with applicable digital content regulations.


§ 7 Live Q&A Sessions

  1. Live sessions are independent online events.

  2. They are conducted via Zoom or comparable video conferencing systems.

  3. There is no entitlement to individual consultation or personal medical advice.

  4. The Provider may reschedule events for good cause (e.g., illness, technical disruption).

  5. If an event is cancelled without replacement, refunds are handled via Digistore24.


§ 8 Telegram Groups (Voluntary Bonus)

  1. Telegram groups may be offered as a voluntary bonus.

  2. They are not part of the contractual main performance.

  3. Communication takes place independently among participants.

  4. The Provider assumes no liability for user-generated content.

  5. No medical consultation is provided within these groups.

  6. The Provider may exclude participants in case of violations of group rules.


§ 9 Intellectual Property Rights

  1. You receive a non-exclusive, non-transferable, non-sublicensable license for personal use during the access period.

  2. Sharing login credentials is prohibited.

  3. Reproduction, redistribution, or public communication of content is prohibited.


§ 10 Medical Disclaimer and Regulatory Notice

  1. All services are provided exclusively for general informational and educational purposes.

  2. No medical treatment contract is concluded.

  3. No individual medical history, diagnosis, therapy recommendation, or medical advice is provided.

  4. The services do not constitute telemedicine.

  5. The services do not replace examination, diagnosis, or treatment by a licensed physician.

  6. No promises of healing or medical success are made.

  7. Participation and application of any information is at your own responsibility.

  8. The services are not directed to residents of jurisdictions where the provision of such informational services would require specific local medical licensing.


§ 11 Liability

  1. The Provider shall have unlimited liability for intent, gross negligence, and injury to life, body, or health.

  2. In cases of slight negligence involving breach of essential contractual obligations, liability is limited to foreseeable and typical contractual damage.

  3. The Provider assumes no liability for temporary technical unavailability or system failures beyond its control.

  4. Nothing in these GTC excludes mandatory consumer rights under applicable law.


§ 12 Force Majeure

In cases of force majeure, performance obligations are suspended. If the event continues for more than three months, either party may terminate the contract.

§ 14 Applicable Law

German law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

For consumers within the EU/EEA, mandatory consumer protection provisions of their country of residence remain unaffected.


§ 15 Jurisdiction

For entrepreneurs, the place of jurisdiction is Freiburg im Breisgau, Germany.

For consumers, statutory provisions apply.


§ 16 Dispute Resolution

The Provider does not participate in dispute resolution proceedings before a consumer arbitration board.
